3. No Emergency or Professional Services

Unless specifically agreed otherwise in writing, Powell Systems services are not intended to replace emergency services, licensed professional advice, or human judgment in situations involving health, safety, legal, financial, or other high-risk matters.

Users should contact the appropriate emergency service or qualified professional when necessary.

4. Customer Responsibilities

Customers are responsible for:

Providing accurate and current business information

Providing correct pricing, policies, hours, service areas, and scheduling information

Maintaining access to required third-party accounts and integrations

Informing Powell Systems of material changes to their business

Ensuring their use of our services complies with applicable laws and regulations

Obtaining any legally required permissions or consent from their customers

Powell Systems is not responsible for errors resulting from inaccurate, incomplete, or outdated information supplied by a customer.

5. Third-Party Services

Our services may depend on third-party platforms and providers, including telecommunications providers, AI providers, CRM systems, payment processors, calendar providers, hosting providers, and other software services.

These third-party services may experience outages, service interruptions, pricing changes, policy changes, or technical problems outside Powell Systems' control.

We do not guarantee the continuous availability of any third-party service.

6. Payments and Subscriptions

Certain Powell Systems services are offered through recurring subscriptions.

By purchasing a recurring service, you authorize the applicable payment processor to charge your selected payment method according to the pricing and billing schedule presented at checkout or in your service agreement.

Unless otherwise stated:

Subscription fees are billed in advance.

Subscriptions automatically renew until canceled.

Cancellation prevents future renewals but does not normally result in a refund for an already-paid billing period.

Leads

Appointments

Calls

Sales

Customers

Reviews

Revenue

Search-engine rankings

Business results

Results vary based on numerous factors outside our control.

12. Disclaimer of Warranties

To the fullest extent permitted by law, the website and services are provided on an "as is" and "as available" basis.

Powell Systems disclaims warranties not expressly stated in a written agreement, including implied warranties of merchantability, fitness for a particular purpose, and uninterrupted availability.

13. Limitation of Liability

To the fullest extent permitted by applicable law, Powell Systems LLC will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from the use or inability to use our website or services.

The customer's violation of applicable law
